Description:

This masterclass examines the severe consequences of misrepresentation under IRPA section 40 and the exceptionally narrow "innocent mistake" exception established by the Federal Court. Participants will review the dual subjective-objective test, the obligation of officers to issue Procedural Fairness Letters (PFLs) and analyze key Federal Court precedents to distinguish between deliberate deception and honest administrative errors.
